Hire Contract - Terms & Conditions

Definitions

1.1 The ‘CLIENT’ means the person/s, organisation or company booking the equipment, act or entertainment with the ‘COMPANY’.

1.2 The ‘COMPANY’ means The Pyjama Party Company.

1.3 ‘Dry hire’ is the hire of equipment for the ‘HIRER’ to operate and supervise themselves.

1.4 ‘Wet hire’ is the hire of equipment or entertainment accompanied by a representative of the ‘company’ to supervise use of the booked equipment or entertainment.

1.5 The period of hire is from the date specified in the contract until the following day at an agreed time unless stated otherwise.

1.6 The contract is written to comply with the English Contract Law.

Bookings

2.1 All equipment remains the property of the COMPANY at all times.

2.2 In the event of traffic or other uncontrollable circumstances preventing us from being able to fulfil our contracted obligations our liability shall be limited to a refund of any monies paid, other than the non-refundable deposit, in relation to the contracted event or a pro-rata reduction in the hire fee in the event of delayed start. No further compensation will be paid.

2.3 The equipment hired is intended for the use of children over the age of 4 and below the age of 13, unless otherwise specified. Please ensure that no person outside of this age range uses the equipment. This is to avoid any possible injury to persons or damage to the equipment.

2.4 It is the full responsibility of the CLIENT to ensure they have adequate space for your booking. We are unable to assist in the moving of furniture so we request the area is cleared prior to our arrival.

Prices, Deposit & Balance Payments

3.1 All hires are subject to a non-refundable deposit of a minimum amount of £50.

3.2 The balance to be paid in full and cleared 7 working days prior to the event start date of the party.

3.3 Prices are subject to change however, prices quoted at the time of booking will be honoured.

Location, Facilities & Conduct

4.1 Hired equipment will be set up in one location only as agreed on arrival and will not be moved once unloaded.

4.2 The equipment must be used indoors only, unless agreed and set up by The Pyjama Party Company in one of our bell tents or domes.
4.3 The COMPANY reserves the right to refuse delivery if the venue or site is deemed to be unsuitable. In such a case no refund will be given and the full hire fee will be due.

4.4 It is the responsibility of the CLIENT to ensure that all reasonable steps are taken to avoid injury or cause damage to the equipment. The CLIENT agrees to supervise the equipment at all times and have a duty of care with the equipment which includes but is not limited to:
a.) ALL shoes and sharp objects MUST be removed before using the equipment.
b.) NO face paints, slime, food, drink, chewing gum, pets, smoking, illicit substances or sharp objects to be allowed on or near the equipment. This will avoid possible soiling of the equipment.
c.) Climbing or hanging on the wooden parts of the equipment is dangerous and must NOT be allowed.
d.) Naked flames, cigarettes, matches or candles are strictly forbidden around our equipment, although they are CE tested, they are still flammable and should be kept away from all forms of fire

4.5 The CLIENT is responsible for any damage or soiling of the equipment and agrees to indemnify the cost of cleaning or replacement.

4.6 Bell tent hire
a.)  The garden is secure to prevent theft or criminal damage to the equipment.
b.) The bell tent can only be pitched on natural grass, not astroturf or similar artificial grass products.
c.) The ground where the tent is to be pitched must be relatively level and cleared of animal faeces before tent can be pitched.
d.) The client is responsible for ensuring they have adequate space to accommodate the tent.
e.) There must not be any overhanging trees where the tent is pitched, to avoid birds soiling and damaging the tent.
f.) No heaters or candles are to be used inside or near the tent to avoid fire risk.
g.) The client is responsible for any damage to the tent or equipment whilst on hire this includes but is not limited to; NO face paints, slime, food, drink, chewing gum, domestic pets, smoking, illicit substances or sharp objects to be allowed on or near the equipment. This will avoid possible soiling of the equipment. If there is any soiling that requires excessive cleaning the client will be charged.
h.) A damages deposit of £100 is held to secure against potential damage to the equipment during the hire period. Once the company has inspected the equipment and is satisfied no damage or excess cleaning is required the damages deposit will be returned to you either in part or full as long as any charges do not exceed the deposit amount.
i.) There must be onsite parking to aid unloading/loading of equipment.

Liability & Insurance

5.1 The COMPANY liability insurance covers use of the equipment only whilst booked on ‘wet’ hire.

5.2 The CLIENT agrees to indemnify the company for any damage or theft of the COMPANY’s equipment whilst on hire.

5.3 The COMPANY accepts no liability for any damage or loss of personal property and or any injury arising from the use of the hired equipment.

5.4 Any damage to the equipment caused by misuse, neglect, loss or failure to follow conduct instructions, shall deem the CLIENT liable for full repair or replacement costs in addition to any loss of business.

 

Hire Conditions

Contract Terms & Conditions of Hire

If the CLIENT is in any doubt as to the meaning of the following, a representative from The Pyjama Party Company should immediately be consulted before signing this contract by emailing info@thepyjamapartycompany.co.uk or via telephone on 07950 002757.

6.1 The CLIENT will, during the period of hiring, be responsible for the supervision of the equipment, its care, safety from damage however slight or change of any sort, and the behaviour of all persons of all ages using the equipment whatever their capacity, including proper supervision of children. The Pyjama Party Company excludes any liability for injury loss or damage caused to any person using the equipment contrary to the terms and conditions of this Contract.

6.2 In all hiring contracts a refundable damages deposit of £50.00 for indoor hire or £100 for outdoor hire in the form of either a cash payment or bank transfer is payable. The damages deposit is to be returned to the CLIENT within 72 hours of return of the equipment unless the hired equipment and any accessories have been damaged, soiled or lost during the period of hire and in such circumstances, the deposit will be used in full or part payment of those repairs/replacements. The CLIENT shall indemnify for the full cost of repair of any damage done to any equipment which may occur during the period of the hiring.

6.3 The CLIENT shall not use the equipment for any purpose other than that described in the TERMS & CONDITIONS and shall not sub hire or use the equipment or allow the equipment to be used for any unlawful purpose or in any unlawful way.

6.4 Public liability insurance is excluded in its entirety following any claim or injury to any third party or employee whether directly or indirectly related to the use of drugs and/or alcohol.

6.5 If the CLIENT wishes to cancel or amend the booking for whatever reason we require 14 days notice of the changes. Failure to provide this will result in the CLIENT being liable for the full cost.
